Buying Sap-Ing-Sit in Thailand: What to Check Before Paying

Last checked 8 October 2026 · 3 min read · English

Sap-Ing-Sit is a registered statutory right to use immovable property. It can be transferred, mortgaged and inherited, but acquiring it does not make you the landowner. Due diligence must cover both the underlying property and the right being acquired. [1]

Start with What Is Sap-Ing-Sit? How Does It Compare with Leasehold? if you need an explanation of the legal structure.

Check the property and registration documents

The Act covers land with a Chanote title, such land with buildings, and condominium units under condominium law. It does not cover every type of land document. Establishing the right over only part of the property identified in the land or condominium title is prohibited. [1, sections 3–4]

Check the title, including its registration entries, and the Sap-Ing-Sit certificate if the right already exists. Match document numbers, the registered holder, location and property description against current Land Office records. A photograph supplied by the seller is insufficient on its own.

Distinguish a new establishment from a resale

For a proposed new establishment, confirm the owner's authority and what happens to your payment if registration cannot be completed. For an existing right, check the expiry date. A transfer does not automatically provide a fresh 30-year term. Department of Lands guidance prohibits registering a transfer with a duration different from the certificate. [2, Sap-Ing-Sit chapter, question 7]

For example, a right expiring on 31 December 2056 still expires then if transferred in 2036. See Transferring Sap-Ing-Sit and the Remaining Term.

Check encumbrances and signing authority

Establishing the right over property already subject to a mortgage, registered business security or another registered right requires the relevant holder's written consent under section 4. Also check whether the Sap-Ing-Sit itself is mortgaged, subject to a registration restraint or disputed, and how those matters will be resolved. [1]

For a corporate owner, verify authorized signatories and transaction approvals. For an individual, check spousal consent where required and the scope of any power of attorney. The Department's establishment manual identifies documents according to the applicant and property involved. [4]

Registration does not eliminate every creditor risk. Section 9 preserves the owner's ability to transfer ownership or use it as security. Enforcement consequences require a transaction-specific review of priority and documents. [1]

Check practical use and the end of the term

Investigate access rights, planning restrictions, building permissions, condition and building rules. Sap-Ing-Sit does not exempt a business, alteration or short-term letting from other applicable laws. [1, section 10]

For buildings constructed, altered or extended by the right holder, section 11 provides for ownership to pass to the underlying owner when the right ends unless otherwise agreed; the provision excludes work to condominium units. Review this together with the property's return conditions. [1, sections 11 and 15]

Make payment conditions clear

The agreement should identify the right, expiry, price, payment stages, encumbrances to be resolved, costs and refund conditions if registration fails. This is a review checklist, not a universal contract template. Prepare your budget using Sap-Ing-Sit Fees and your family plan using Sap-Ing-Sit Inheritance.

Frequently asked questions

Is a certificate enough to justify paying a deposit? Check current registration, seller authority, remaining term and refund conditions first. A certificate does not validate every sales claim.

Does this give me land ownership? No. It gives the statutory right being acquired, subject to its term and applicable law.
